Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and What's The Point? ("we", "us", or "our"), governing your access to and use of the What's The Point? mobile application, websites, and related services (collectively, the "Service"). By creating an account, checking the acceptance box, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who may use the Service

You must be at least 18 years old and a resident of the United States to use the Service. By using it, you represent that you meet these requirements and that the information you provide is accurate and current. You are responsible for all activity under your account and for keeping your login credentials confidential.

2. What the Service does

What's The Point? helps you view your own credit-card rewards — in particular your American Express Membership Rewards points balance and points transaction history — in one place. You log in to your card issuer through your own device, and the Service reads and organizes your rewards data on a read-only basis. The Service does not move points, make redemptions, initiate payments, or change anything in your card-issuer account.

3. Third-party accounts and trademarks

The Service is not affiliated with, endorsed by, sponsored by, or in any way officially connected to American Express or any other card issuer. "American Express" and "Membership Rewards" are trademarks of American Express, and all other trademarks are the property of their respective owners; they are used only to describe compatibility.

When you choose to link a card-issuer account, you authorize What's The Point? to access and store the rewards information described in our Privacy Policy on your behalf. Your use of any third-party account remains subject to that third party's own terms, and you are solely responsible for complying with them. We are not responsible for the third party's services, availability, accuracy, or for any action it takes in response to your use of the Service.

You enter your card-issuer credentials directly into the issuer's own login page. We do not ask for, receive, or store your card-issuer password or one-time codes. See the Privacy Policy for what we do and do not collect.

The Service is for informational purposes only. Points balances, valuations, and transaction data are provided "as is" and may be delayed, incomplete, or inaccurate. Nothing in the Service is financial, investment, tax, or legal advice, and you should not rely on it as such. Always verify balances and activity directly with your card issuer.

7. Intellectual property

The Service, including its software, design, and content (excluding your data), is owned by What's The Point? and its licensors and is protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. You retain ownership of the data you provide or that we collect on your behalf.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY DATA WILL BE ACCURATE OR COMPLETE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, What's The Point? AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, POINTS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) US $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless What's The Point? and its owners, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or to protect the Service. Sections that by their nature should survive termination (including Sections 6–10 and 12) will survive.

12. Governing law and disputes

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. Except where prohibited, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, and you and we waive any right to a jury trial or to participate in a class action. Notwithstanding the foregoing, either party may bring an individual claim in small-claims court. If arbitration is found unenforceable, the state and federal courts located in Michigan will have exclusive jurisdiction.

13. Changes to the Service or these Terms

We may modify the Service or these Terms at any time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
